TERMS AND CONDITIONS
1. INTRODUCTION
These Terms and Conditions apply to the use of the Boho Flowers website and, by accessing our website and/or placing an order you agree to be bound by the Terms and Conditions set out below. If you do not agree to be bound by these Terms and Conditions you should not access our website.
2. ORDERS AND CANCELLATIONS
Pricing
a. We are not VAT registered.
b. We reserve the right to amend the prices indicated on our website at any time, without notice.Description of products and product images
c. All our flowers are grown by us or other British flower farmers. Occasionally we have to substitute from local traders. Every bunch or bucket is unique as we are using natural materials and every bunch is made to order. Therefore there may be slight variations to the flowers in the bunch you receive, as compared to the product images on our website.
d. Each item purchased is sold subject to its product description which sets out additional specific conditions related to that product including, without limitation, terms and conditions concerning estimated delivery dates and times, warranties, after-sales service and guarantees.Flower availability and substitution
e. All floral products are subject to availability. In the event of any supply difficulties, we reserve the right, at our absolute discretion, to substitute any product with an alternate product of a similar style and equivalent (or greater) value and quality.
f. Order Acceptance Policy - All orders received are subject to acceptance by Boho Flowers and any of its personnel reserve the right, at our absolute discretion, to reject any order without giving reasons. In the event of rejection, we will refund or cancel any payments received in full, via the payment method used to place the order.
g. Workshop cancellation and changes: We do not offer refunds, however, if you are unable to attend a workshop or event that you have already paid for, you can receive credit for the amount of the ticket which can be spent on any product or workshop in our shop within the next 12 month period.
3. Payments
a. If you are buying off of the website: We accept American Express, Visa and MasterCard credit and debit cards. In order to offer the best security, all our payments are processed securely by Stripe Payments.
b. If you are buying specific buckets for events: we will invoice for a bank transfer.
c. We never store or have access to your credit or debit card details.
d. Full payment must be prior to collection.
Delivery
e. We only deliver at our own discretion. We do not offer delivery on our website and will only deliver in special circumstances.
f. Boho Flowers delivers within the United Kingdom only.
g. Although our team will always try our best to ensure punctual delivery, Boho Flowers cannot be held responsible if a delivery arrives late due to any circumstances impacting the availability of the postal service or anything else outside of our control.
h. A delivery charge will be added to any final invoice. This is determined by us at the time of purchase.
Cancellation policy
i. Please contact us as soon as possible if you wish to cancel your order.
j. We are unable to cancel orders once they have been collected or delivered.
k. In regards to events, we ask for a 10% deposit at booking, full final payment 14 days before. You will be unable to cancel with refund 14 days prior to the event date.
4. RETURNS AND REFUNDS
Damage
a. We carefully pack our flowers to ensure they are in perfect condition. However, occasionally, they may get damaged in transit. Should this occur, please email us a photo of the damaged flowers within 72 hours of receipt. If, at our sole discretion, the flowers appear damaged, we will offer you a free replacement at our next available delivery date or a refund.
b. If we offer you a refund, we will refund you the full amount within 3 days. Please note that banks may take an additional 3-5 days to refund the amount to your card.
Returns
c. Due to the perishable nature of flowers, we are unable to accept returns.
5. HAZARDOUS PLANT MATERIAL
a. Please note that although we check all flowers for disease and infection at the point of cutting, some flowers may be harmful or poisonous. In particular, your arrangement/buckets may potentially contain flower and foliage which are poisonous and toxic if ingested. Please do not eat any flowers you receive and avoid contact with children and animals. Please wash your hands before eating or drinking after handling flowers. We would always advise wearing gloves when handling natural products such as flowers and foliage.
b. Please contact us prior to collection if you have any specific allergies/issues with this.
6. OFFERS AND PROMOTION CODES
a. At our discretion, we may offer products at discounted prices from time to time. These offers are valid from the time that we introduce them to the end date of the offer and they cannot be used for purchases before the offer introduction date or after the offer end date.
b. In the event that a customer has made a purchase and the price of the purchased product subsequently falls or is discounted due to a special offer, the price of the product at the time of purchase shall prevail. We are unable to offer special offer discounts for purchases that have already been made.
c. As our special offers are contingent on availability, we may change the terms of special offers and promotional codes, or withdraw them altogether, at any time, and without prior notice.
d. We also reserve the right, at our absolute discretion, to offer different personalised special offers and promotions and it will therefore only be possible for the customer in receipt of the special offer to redeem the discount.
e. During the checkout process you may be given the option to enter any promotional details or discount codes. These codes are non-transferable and there is no cash alternative. Furthermore, they cannot be used in conjunction with any other promotion code or offers and must be redeemed by the date published, if provided.
7. INTELLECTUAL PROPERTY
a. You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all materials and/or content made available as part of your use of the Boho Flowers website shall remain at all times vested in us or our licensors. You are permitted to use this material only as expressly authorised by us or our licensors.
b. You acknowledge and agree that the material and content contained within the Boho Flowers website is made available for your personal non-commercial use only and that you may only download such material and content for the purpose of using the Boho Flowers website. You further acknowledge that any other use of the material and content of the Boho Flowers website is strictly prohibited and you agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.
8. CIRCUMSTANCES BEYOND OUR CONTROL
a. Adverse weather conditions: During bad weather conditions our deliveries may occasionally be affected. We will always do our best to keep such circumstances to a minimum and to keep you informed. We will endeavour to complete your order or to complete your delivery at our next available delivery date. We will not provide a refund where the non-performance, or delay in performance, of any of our obligations under the agreement arising is caused by circumstances beyond our reasonable control.
b. Unforeseen circumstances: Where things like civil strife, terrorist attacks, natural disasters, fires, technical problems with our systems, compliance with laws or governmental orders rule, judgments or decrees of any court or jurisdiction, or other matter beyond our reasonable control that disrupt our usual operations.
9. OUR LIABILITY
a. We warrant to you that any product purchased from us is of satisfactory quality and fit for all the purposes for which products of the kind are commonly supplied.
b. We do not make any other promises or warranties about the Boho Flowers website or our products. Additionally, our liability for losses you suffer as a result of us breaking this agreement or any other duty is strictly limited to the purchase price of the products you purchased and any losses that were foreseeable to both you and us when the contract for the sale of items by us to you was formed. We will not be responsible for indirect losses that were not foreseeable by you and us such as loss of income or revenue, loss of business, loss of profits or contracts or loss of anticipated savings however arising and whether caused by tort (including negligence), breach of contract or otherwise.
c. This does not include or limit in any way our liability resulting from any misrepresentation, or any liability for death or personal injury caused by our negligence or Boho Flowers' liability for fraudulent misrepresentation.
10. INDEMNITY
You agree fully to indemnify, defend and hold us, Boho Flowers, and our officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of any breach of the Terms and Conditions by you or any other liabilities arising out of your use of the Boho Flowers website, or the use by any other person accessing the website using your shopping account and/or your personal information.
11. CUSTOMER AND RECIPIENT PERSONAL INFORMATION
a. To ensure that we can communicate effectively with both customers and recipients, it is very important that you provide accurate personal information.
b. Please remember that we value your privacy and will never lease, rent or sell your private information. For more information, please see our privacy policy.
c. Please note that for the purposes of the prevention or detection of offences, and for the purpose of safeguarding the vulnerable, we may share some information with the police or other professional bodies. This is only done where it is considered necessary for the prevention and detection of crime or the need to safeguard children and vulnerable adults.
d. As a customer, you can opt in, or out, of our newsletter communications at any time.
12. GENERAL
a. We may amend these terms and conditions from time to time, and post the new version on the Boho Flowers website. When we do so, we will post a notice of that fact on our Home page.
b. All matters concerning and incidental to any offer or agreement for the purchase and sale of products from our website shall be in English and construed and governed according to English Law and the English courts shall have jurisdiction in all such matters.
13. Boho Flowers
a. We offer bucket hire and hold workshops at our premises and these are subject to additional terms and conditions.
